New Law focusing on employer-employee relationship likely soon


The private sector employees can soon quit their jobs and receive compensation, if their well-being or dignity is hurt by their employers, according to a new court order.


The Shura Council, which approved articles under a new labour law, agrees that employees are allowed to quit jobs during such situations and file a complaint in court for unfair dismissal.


The articles stipulate that employees have the right to terminate their contract whenever they feel their employer is disrespecting work ethics or if they are being humiliated.


However, the employees need to give a 30-day notice and inform employers about the violation. In case there is no response, the employees will have to obtain a court order indicating the unfair treatment meted out to them and claiming for compensation.


Meanwhile, the employer has the right to terminate a contract whenever it is proven that the employee has submitted bogus credentials and work experience. The employer can also terminate the contract, if the employee commits a major mistake which leads to losses. However, the employer can do so only when the fault of the employee is proven.


The other reasons for which the employers are given right to terminate the contract of employees is when an employee absents from work for 20 working days or 10 consecutive days in a year, for no valid reason, or when the employee makes public any vital information or has committed a major crime.


However, the council has decided to postpone vote on an article that requires the employer to take disciplinary action against employees due to lack of information on procedures. The two other articles that have been postponed vote that are the one granting employees right to terminate contracts without penalties, as it was considered as being unfair to employers, and also postponement of the article granting employer the right to terminate contracts whenever the company plans downsizing due to losses, as it is considered to be against employees’ rights.


The Services Committee Vice-Chairman and Secretary, Sameera Bin Rajab, said that under the law, a new office would be established at the Labour Ministry to look into disputes between employers and employees in the government sector. If the new office is unable to solve the dispute, the case will be transferred to the court.


The Council will continue discussion on the law at its weekly session next Monday.
